URGENT: Wheelchair-Bound Anti-Regime Activist Hadi Jahednorouzi at Imminent Risk of Illegal Deportation to Iran by the Cyprus Government | Letter-Writing Action Included

Hadi Jahednorouzi (ARC: 5395940) is an Iranian asylum-seeker at imminent risk of illegal deportation to Iran by the government of Cyprus. He was arrested three times in Iran in connection with his political activities, including the reproduction and dissemination of anti-regime literature. Not only was Hadi and his family incessantly persecuted in Iran, but when Hadi escaped from Iran, he began participating in anti-Islamic Republic activities, including protest actions as a member of the Iranian National Front and the Cyprus Refugee Rights Movement. Key documents in Hadi’s case were refused admittance into the record by Cypriot authorities, and his rejection decision was implemented without having all available evidence at hand. Hadi was told that he would be deported on Tuesday 23 August. Urgent assistance is needed to stop Hadi’s deportation. Please urgently participate in this letter-writing action yourself, and encourage others to participate.

To the Cypriot Authorities:

Hadi Jahednorouzi (ARC: 5395940) is an Iranian asylum-seeker at imminent risk of illegal deportation to Iran by the government of Cyprus. This sick, wheelchair-bound refugee was arrested on Sunday, 21 August 2011 and was told by the police that he would be deported to the hands of the Islamic Republic on Tuesday, 23 August 2011.

Hadi fled Iran in the year 2000 due to incessant persecution of his family by regime authorities as a result of his brother’s significant activities with the Mujaheddin-e Khalq organization. Among these persecutions, Hadi reports that the regime killed his mother by poisoning in 1993 during the period of the Chain Killings in Iran. Hadi himself was arrested on 3 occasions in association with his political activities, which included reproducing and distributing anti-regime pamphlets and magazines. On one occasion, regime thugs ransacked his home and confiscated his copying equipment.

Hadi entered Cyprus in 2005 and sought asylum. He has since been very active against the Islamic Republic: he has regularly attended protests against the Islamic Republic regime both with the Iranian National Front organization and with the Cyprus Refugee Rights Movement. Hadi’s membership in the Iranian National Front, which is documented at least since 2002, pre-dates his entrance into Cyprus and is another indicator of the duration and extent of his political activities against the regime.

Under the concept of “sur place,” Paragraph 96 of the rights of asylum-seekers under the Convention Relating to the Status of Refugees clearly states that people have the right to asylum on the basis of political activities they have engaged in abroad. Hadi has been publicly, documentably active against the Islamic Republic during his time in Cyprus. Photographs of his political activism against the Islamic regime have been disseminated via the internet. This wheelchair-bound activist recently suffered a stroke. He is weak and in very poor health, yet even these problems could not overcome his convicted opposition to the regime; he has continued to join demonstrations against the Islamic Republic.

Given published evidence that the Islamic Republic is keeping tabs on individual Iranian asylum-seekers abroad [1], and is prosecuting returned asylum-seekers under Article 7 of the Islamic Penal Code as criminals who have propagated against the regime while abroad [2], if Cyprus deports him, it will be a breach of international law and will put Mr. Jahednorouzi’s life at risk. The Islamic Republic of Iran’s willingness to detain, torture and execute political prisoners of any age and infirmity is well-known and documented. Paraplegic political prisoner Hadi Abedi Bakhoda was recently lashed 51 times by the Islamic Republic while wheelchair-bound and unable to move. Earlier this year, the Islamic regime executed 62-year-old Ali Saremi because of his son’s affiliation with Mujaheddin-e Khalq.

Hadi’s lawyer is on the record as stating that Hadi’s case has been decided too quickly by the Cyprus Asylum Office, that not enough research has not been done, that the reasons for rejection of his case are not sufficient to deny him asylum. Most importantly, the lawyer is on the record as stating that Hadi has other supporting documents for his case, but the asylum officer refused to admit them into Hadi’s file. Hadi Jahednorouzi’s asylum application has been rejected without these documents being taken into consideration.

For all of the above reasons, we demand that Mr. Hadi Jahednorouzi be immediately released from detention, any plans for deportation be immediately canceled, his asylum case re-opened, and his additional documents entered into his asylum application file.

[2] Rahim Rostami’s case (deported from Norway to detention in Evin Prison in Iran as a political prisoner) demonstrates that the regime is prosecuting returned political asylum-seekers on the basis of Article 7 of the Islamic Penal Code. From 19 June 2011: „According to sources Iran Human Rights (IHR) has been in contact with, Rahim Rostami has been charged with „Contact with alien countries and propaganda against the nation’s security.““ … „Mahmood Amiry-Moghaddam, the spokesperson of IHR said: The new charges against him are due to his participation in anti-government (Iranian) rallies while he was in Norway. This shows that the Iranian authorities monitor activities of the Iranians abroad and use it against them upon their return.“ http://iranhr.net/spip.php?article2138
